NY v. Trump: Defense Concludes Without Ex-President's Testimony, Seeks Dismissal

Fox News reported that defense attorneys concluded their arguments in the New York v. Trump case without calling former President Trump to testify, and a motion to dismiss the case is still pending.

Manhattan District Attorney Alvin Bragg has charged Trump with 34 counts of falsifying business records in the first degree.

These charges pertain to a $130,000 payment to adult film actress Stormy Daniels, which prosecutors claim was intended to prevent her from discussing an alleged affair with Trump during the 2006 election cycle.

Trump's former attorney, Michael Cohen, played a pivotal role in the prosecution's case, testifying that he facilitated the contested payment through a home equity line to keep it concealed from his wife. Interestingly, he stated he was reimbursed $420,000 for the hush money by Trump, a sum documented through checks falsely described as “retainer” payments.

Jury to Deliberate After Memorial Day

During the trial, the defense and the prosecution offered contrasting narratives about Trump's involvement and intent. Trump's attorney, Todd Blanche, argued vehemently that there was no evidence proving Trump had any intent to commit fraud or mislead, challenging the credibility of Cohen's testimony in the process.

"How on Earth is keeping a false story from voters criminal?" Blanche posed in court, reflecting the defense's argument that no direct fraudulent action could be attributed to Trump.

On the other hand, Prosecutors maintained that Trump orchestrated the sequence of events leading to the falsification, which they argue is sufficient for conviction under New York law.

"As a matter of law, it is sufficient, more than sufficient, that the defendant set in motion the sequence of events leading to the falsification of business records," stated Prosecutor Matthew Colangelo.

Trump Conveys Confidence in Legal Outcome

Reacting to the day's proceedings, Trump expressed confidence in the outcome, remarking outside the courtroom, "We've practically already won." He also criticized Judge Merchan's refusal to dismiss the proceedings, directing frustrations towards DA Alvin Bragg: "He should side decisively against [DA Bragg]."

The trial has now paused until after Memorial Day, with closing arguments set for May 28, 2024. Upon conclusion, the jury will deliberate, a process set to commence no earlier than that afternoon. However, Judge Merchan retorted that if Cohen's "lies were 'irrefutable,' then he would be able to convince the jury of that."
