This policy revision aimed to shield individuals from discrimination based on their self-asserted gender identity, particularly in various academic levels, from 12 to higher education institutions reliant on federal support.

The expansive interpretation faced immediate hurdles, with lower courts halting enforcement in over two dozen states, signaling skepticism. U.S. Solicitor General Elizabeth Prelogar proposed a compromise, urging partial enforcement while courts addressed contentious aspects.

However, the Supreme Court found the regulations too integrated to implement piecemeal, reinforcing their indivisibility as the rules were set to begin on August 1.
