Nearly 1 Million Migrants Remain In U.S. Under Biden-Harris Policies, Say House Panel

A significant shift in immigration policy has emerged as federal courts grapple with an unprecedented number of migrant cases under President Biden and Vice President Harris's administration.

According to a New York Post report, the House Judiciary Committee released findings Thursday revealing that over 700,000 migrants have had their immigration cases dismissed, terminated, or administratively closed.

The Department of Homeland Security failed to initiate removal proceedings for an additional 200,000 cases. The comprehensive 16-page report exposed a dramatic 575% increase in case dismissals compared to the previous administration.

Under Trump's tenure, approximately 104,000 migrants had their cases dismissed, terminated, or administratively closed, highlighting a stark contrast in immigration enforcement approaches.

Breaking Down The Immigration Case Numbers

Data compiled by the House committee, tracking cases from January 20, 2021, to June 30, 2024, revealed that 459,356 cases were dismissed during this period. The figures show an additional 172,645 cases were terminated, while 71,465 cases underwent administrative closure.

During the Trump administration, according to data from the Transactional Records Access Clearinghouse at Syracuse University, 90,692 immigration cases faced termination or dismissal. The Justice Department's Executive Office for Immigration Review previously combined these categories, making direct comparisons challenging.

The stark difference becomes even more apparent when considering that only 13,590 cases were administratively closed under the previous administration, according to House Judiciary Committee data.

Current Administration Policy Implementation

Homeland Security Secretary Alejandro Mayorkas acknowledged in January that over 85% of asylum seekers apprehended at the southern border were being released into the U.S. while awaiting immigration hearings. This admission came amid unprecedented pressure on the immigration system.

The immigration court system currently operates with approximately 700 judges managing an overwhelming caseload. This situation prompted Attorney General Merrick Garland to reverse Trump-era restrictions and reinstate the "administrative closure" policy in July 2021.

Former Executive Office for Immigration Review Director David Neal issued guidance encouraging judges to support agency lawyers seeking case dismissals, contributing to the significant increase in case closures.

Border Management And Policy Evolution

The Biden administration implemented significant changes to border management strategies throughout their term. In June, facing mounting pressure, Biden issued an executive order allowing temporary border closure when migrant crossings exceeded 2,500 per day over a week-long period.

This policy shift still permits approximately 1.8 million migrants to enter the country through alternative pathways, including the humanitarian parole process. Congressional Republicans have criticized this approach as potentially misusing the system.

DHS has reported notable success in some areas, citing the removal of more than 700,000 migrants in fiscal year 2024, marking the highest number since President Obama's administration in 2010.

Electoral Implications And Public Response

The House Judiciary Committee stated:

Through administrative maneuvering at both the Justice Department and DHS, the Biden-Harris Administration has already ensured that nearly 1 million illegal aliens can remain in the United States without the possibility of deportation — and that trend shows no sign of stopping. This sort of quiet amnesty has become a staple of the Biden-Harris Administration's immigration courts.

Immigration continues to dominate political discourse in crucial swing states including Nevada, Arizona, Wisconsin, Michigan, Pennsylvania, North Carolina, and Georgia. Recent polling data from the Wall Street Journal indicates Trump maintains a 16-point advantage over Harris regarding illegal immigration management.

State Impact And Administrative Challenges

The massive case dismissals have created varying impacts across different states, with border states facing particular challenges. The situation has left hundreds of thousands of migrants in an unusual legal position - lacking proper documentation but able to remain in the country indefinitely.

The administrative burden has led to significant operational changes within immigration courts. The current system struggles to process the extensive backlog while implementing new policies and procedures under the current administration's guidance.

House Speaker Mike Johnson's recent revelation about his unsuccessful attempt to convince Biden to reinstate the "Remain in Mexico" policy highlights ongoing tensions between legislative and executive approaches to immigration management.

Path Forward Through Policy Crossroads

The current situation reflects a complex interplay between court capacity, administrative policy, and practical implementation challenges. The dramatic increase in case dismissals and closures represents a significant departure from previous immigration enforcement approaches.

Harris's recent CNN town hall acknowledgment of the need for additional immigration judges while defending the administration's border policies indicates recognition of systemic challenges while maintaining support for current policy directions. The impact of these policies continues to shape both the immediate immigration landscape and longer-term political discourse.
