Senate urged to swiftly confirm Emil Bove to appeals court post

Emil Bove’s nomination to the Third Circuit Court of Appeals is a bold move by President Donald Trump, stirring both applause and skepticism among conservatives. Bove, a seasoned prosecutor and loyal Trump ally, brings a resume that screams competence but faces pushback for his DOJ tenure. James Burnham, a former Trump administration heavyweight, is rallying the Senate to confirm him fast, as Breitbart reports.

Trump tapped Bove for the Third Circuit, a key appellate court, after a first term that saw him appoint 54 federal appellate judges.

Bove’s nomination follows his high-ranking role at the Department of Justice, where he’s been a fierce advocate for Trump’s agenda. Some conservatives, though, aren’t sold, grumbling about his aggressive tactics.

Bove’s career is a prosecutorial powerhouse: nearly a decade in the Southern District of New York, plus representing Trump in criminal cases before joining the DOJ.

He is a Georgetown Law grad who clerked for Judge Richard Sullivan, a Trump appointee elevated to the appellate bench. That’s the kind of pedigree that should make conservatives cheer, not jeer.

Burnham’s case for Bove

James Burnham, now a principal at King Street Legal, calls Trump’s appellate judges “the finest group” any president has appointed.

He insists Bove fits right in, a judicial home run for conservatives who value constitutional fidelity. “Bove is right down the fairway,” Burnham says, and it’s hard to argue with that track record.

Yet some conservatives balk, pointing to Bove’s DOJ stint as too zealous, even for Trump’s base. They claim he steamrolled career staff to push the administration’s priorities. The case against New York Mayor Eric Adams, in particular, has become a lightning rod for critics who call it a misstep.

Burnham swats away the Adams case criticism like a pesky fly. “The Adams case was fatally flawed from the start,” he says, doubling down on Bove’s judgment. He argues the Senate shouldn’t let one controversial case overshadow Bove’s stellar qualifications.

A proven legal mind

Bove’s time as a prosecutor honed a sharp legal mind, tackling complex cases in one of the nation’s toughest districts. His work for Trump in criminal proceedings showed loyalty and grit, qualities conservatives usually demand in judicial picks. So why the hesitation from some on the right?

The opposition seems less about Bove’s credentials and more about score-settling within the conservative camp. Critics dislike his DOJ playbook, accusing him of sidelining career bureaucrats to execute Trump’s vision. But isn’t that what strong leadership looks like?

Burnham’s credentials bolster his defense of Bove: senior associate counsel to Trump, deputy assistant attorney general, and counselor to the attorney general. He’s seen the judicial appointment process up close and knows what makes a great judge. His endorsement carries weight, and the Senate should listen.

Conservative skepticism examined

The Adams case looms large for Bove’s detractors, who argue it exposed flaws in his approach. They claim it was rushed and poorly executed, undermining Trump’s broader agenda. But judicial nominees shouldn’t be judged on a single case, especially when their resume shines.

Bove’s DOJ role required tough calls, often against entrenched career staff who lean left. Conservatives who champion draining the swamp should applaud his resolve, not nitpick his methods. The Third Circuit needs judges who won’t bow to progressive pressure.

Trump’s judicial legacy is a cornerstone of his presidency, with 54 appellate judges reshaping the federal bench. Bove, with his prosecutorial chops and loyalty to constitutional principles, fits that mold perfectly. Passing him up would be a self-inflicted wound for conservatives.

Senate’s role in confirmation

The Senate now holds Bove’s fate, and Burnham’s urging swift confirmation. Delaying or rejecting him risks alienating the MAGA base, which demands judges who uphold the Constitution over woke ideology. Bove’s record suggests he’s that judge.

Some conservative senators may hesitate, wary of Bove’s DOJ controversies. But they should remember that Trump’s appellate judges have consistently delivered for the right, from religious liberty to Second Amendment cases. Bove would likely follow suit.

Burnham’s final plea is simple: trust Trump’s instincts and confirm Bove. The Third Circuit deserves a judge with his experience, loyalty, and backbone. Conservatives can’t afford to let internal squabbles derail a nominee who could shape the court for decades.
