Mexican national charged with soliciting explicit content from children under 10 using Roblox currency after prior release in Virginia

A Mexican national who allegedly used the virtual currency of a children's video game to solicit sexually explicit images and videos from kids under 10 years old has been hit with an arrest detainer from the Department of Homeland Security and Immigration and Customs Enforcement.

Angel David Rubio Marin was arrested in Prince William County, Virginia, after authorities say he used "Robux," the in-game currency of the massively popular Roblox platform, to entice at least three young children under 10 years old into sending him sexually explicit material.

He entered the United States illegally at an unknown place and time, according to DHS. And this wasn't his first run-in with law enforcement. Rubio Marin was previously charged with two counts of public masturbation but was released in Virginia before the current charges.

Released. Back onto the streets. Where he allegedly went on to target children.

ICE Calls Out Virginia's Sanctuary Policies

Acting Assistant Secretary Lauren Bis did not mince words when discussing the case with Fox News Digital:

"This sicko preyed on innocent children by offering to pay them in a video game currency in exchange for child pornography."

Bis drew a direct line between Rubio Marin's alleged crimes and the state's refusal to cooperate with federal immigration enforcement:

"This illegal alien was RELEASED from jail after an arrest for public masturbation. This case is a perfect example of why we need state and local cooperation with ICE."

The timeline here matters. A man in the country illegally gets arrested for public masturbation. He gets released. He then allegedly turns his attention to children on a gaming platform designed for kids. Every step of that sequence represents a failure, and at least one of those failures was a policy choice.

Bis went further, directly calling on the state's political leadership to act:

"We are calling on Virginia sanctuary politicians and Governor Spanberger to commit to not releasing this child predator back into Virginia neighborhoods."

She added plainly: "No one wants this pedophile loose on American streets."

Spanberger Dismantled the Safety Net

Democratic Virginia Governor Abigail Spanberger ended cooperation between state agencies and federal immigration authorities through an executive directive in February, shortly after her inauguration. The directive reversed the 287(g) program that had been adopted under former Republican Gov. Glenn Youngkin.

The 287(g) program allows trained state and local law enforcement officers to perform specific immigration enforcement functions under federal supervision. It is one of the most effective tools for ensuring that illegal immigrants who commit crimes on American soil don't simply cycle through the revolving door of local jails and back into communities.

Spanberger argued that "requiring state and local officers to take on federal immigration duties diverts them from their primary responsibilities of enforcing Virginia law and investigating crimes."

Read that again in the context of this case. The governor's stated concern is that cooperating with ICE would divert local officers from investigating crimes. Meanwhile, an illegal immigrant who had already been arrested for a sex-related offense was released without ICE notification, and then allegedly committed far worse crimes against children. The policy didn't protect local law enforcement resources. It protected a predator's freedom of movement.

Fox News Digital reached out to Spanberger's office but had not yet heard back.

The Roblox Problem

Roblox is one of the most popular gaming platforms in the world, and its user base skews overwhelmingly young. The platform has made clear that its filters make it impossible for this kind of solicitation to occur through its systems, though the details of how Rubio Marin allegedly made contact with his victims remain part of the ongoing investigation.

What is not in dispute is the target audience. Roblox is where children play. Its currency, Robux, is what children value. The allegation here is that a grown man, in the country illegally, with a prior arrest for sexual misconduct, leveraged a children's economy to exploit children. The sophistication of the predation is the point. This was not random. It was calculated, aimed precisely at the most vulnerable victims in the spaces they trust most.

Cooperation Isn't Optional When Kids Are at Stake

The conservative case for immigration enforcement has never rested on abstraction. It rests on cases exactly like this one. Every policy debate about sanctuary jurisdictions, about 287(g) agreements, about whether local law enforcement should cooperate with ICE, eventually produces a concrete human consequence.

Governor Spanberger made a political choice in February. She ended a program that existed specifically to prevent scenarios where criminal illegal immigrants fall through the cracks of a system that refuses to communicate with itself. The Youngkin administration built that cooperation. Spanberger dismantled it.

The question now is simple. When DHS and ICE have lodged their detainer, when the charges involve the sexual exploitation of children under 10, will Virginia honor it? Or will the state's sanctuary posture hold firm even when the people it shields are accused of preying on kids?

Three children are at the center of this case. They are under 10 years old. They were allegedly targeted by a man who should never have been free to target anyone. The system that was supposed to prevent this was deliberately taken apart.

That is not a policy disagreement. That is a consequence.
