America First Legal Accuses Manhattan DA of Unlawful DEI Hiring Practices

A serious accusation has been levied against Manhattan District Attorney Alvin Bragg by America First Legal, alleging discriminatory employment practices within his office.

America First Legal claims that DA Bragg's office indulges in hiring based on race and sex, violating federal and state laws, as the organization itself explains.

This matter has escalated with the recent filing of a complaint to the Attorney Grievance Committee of the New York First Judicial Department.

The complaint by America First Legal asserts that these practices contravene Rule 8.4(g)(1) of the New York Rules of Professional Conduct, which defines unlawful discrimination as professional misconduct.

The accusations directed at D.A. Bragg and his team focus prominently on these alleged legal shortcomings. The nature of the alleged misconduct ranges from infractions against New York Human Rights Law to violations of the Civil Rights Act.

Earlier actions this month have seen America First Legal escalate its grievances to both federal and state levels.

The organization filed a related federal civil rights complaint with the U.S. Equal Employment Opportunity Commission and a state law complaint with the New York Department of Labor, targeting the same unethical practices under Bragg's leadership.

It is alleged that the Manhattan D.A.'s office uses discriminatory hiring practices labeled as “diversity” initiatives, which specifically advocate for selection based on race, sex, and national origin.

This stands in direct opposition to the office’s public commitment to Diversity, Equity, Inclusion, and Justice principles which promote non-discrimination. Each year, approximately fifty legal staff positions are filled under the guidance of these DEI initiatives, reflecting a significant aspect of the office's operational strategy.

Moreover, application forms supplied by the D.A.’s office for positions such as law clerks, intriguingly solicit information on the candidate's race, ethnicity, and gender, presenting options like "LGBT" but conspicuously excluding "heterosexual" as a category. This inclusion and exclusion of specific demographic details highlight areas of major contention outlined in the complaints.

Commenting on the situation, Dan Epstein, vice president of America First Legal, emphasized the legal obligations of workplaces in America, especially those connected with law enforcement, to maintain an unbiased hiring practice.

“No American workplace is permitted to discriminate based on race or sex. That is illegal," he noted, stressing on the ethical standards expected from leaders within the legal and constitutional guardrails.

Epstein further elaborated on the crucial role of the District Attorney's office. “Lawyers are guardians of the Constitution and the law; compliance with the highest ethical standards is necessary to serve those who need access to justice with fidelity,” he stated, pointing out the serious nature of the allegations against Bragg’s administrative operations. Such standards are what the public expects from its judicial officers and deviations call for stringent scrutiny and responses.
