Court Rejects Steve Baker’s Request For Jan. 6 Trial Postponement After Trump’s Election Victory

A Blaze Media investigative reporter's legal battle takes an unexpected turn as his motion to postpone trial proceedings faces swift judicial rejection.

According to The Blaze, Steve Baker's defense team filed a motion seeking to delay his January 6 criminal trial proceedings, citing Donald Trump's recent presidential election victory and the Department of Justice's pause in Trump's prosecution.

The motion, submitted by defense attorney William Shipley on November 10, requested to vacate all scheduled dates and hearings, proposing a new status conference for February 2025.

Judge Christopher Cooper promptly denied the request, maintaining the original trial schedule set for November 12.

Defense Strategy Highlights Selective Prosecution Claims

Baker, a 64-year-old Raleigh resident and current Blaze Media writer, faces four misdemeanor trespass charges related to his presence at the Capitol on January 6.

His legal team has constructed a defense strategy centered on selective prosecution, compiling a list of over 75 journalists who covered the events but faced no charges. The defense team argues this demonstrates a potential political bias in prosecution decisions.

The defense's argument gains additional context from Baker's professional background as a blogger for the Pragmatic Constitutionalist at the time of the Capitol events. His arrest in Dallas on March 1 included a media-witnessed perp walk at FBI offices, adding a public dimension to the case.

Defense attorney William Shipley emphasized the significance of Trump's electoral victory, stating:

The unique circumstances now before this Court — a president-elect having pledged to reverse the decision-making of the predecessor administration after having made the issue a part of his campaign promises — and the Department of Justice now making a representation on the record in another case that the election outcome is a change in circumstances warranting a delay, justifies defendant Baker making this motion

Legal Setbacks and Judicial Responses

The defense team has encountered multiple setbacks in their legal strategy. Judge Cooper previously issued a nine-page opinion on October 25 rejecting Baker's motion to dismiss the charges.

Additionally, Baker's attempt to retain his firearm rights amid safety threats was denied, with the U.S. Court of Appeals for the District of Columbia Circuit upholding this decision.

The prosecution's position reflects broader considerations about public interest and justice administration. Shipley argued against this perspective, noting:

To deny this motion, in the face of the Justice Department's official position, would run contrary to the interests of justice and likely subject the defendant to criminal convictions for no purpose other than expediency

Baker's defense team has emphasized the historical significance of the case, particularly regarding press freedom and equal treatment under the law. They point to approximately 80 journalists from various media organizations who entered the Capitol through damaged entrances without facing legal consequences.

Implications of Recent Political Developments

Trump's electoral victory, securing 312 Electoral College votes and a 3.6 million popular vote margin, forms a crucial element of the defense's argument for delay. The defense team suggests this political shift should influence judicial considerations, particularly given the DOJ's approach to other January 6-related cases.

The case highlights ongoing tensions between press freedom, law enforcement, and political developments. Baker's role as both a journalist and defendant raises questions about media coverage during civil unrest and subsequent legal accountability.

The intersection of political changes and judicial proceedings continues to shape the legal landscape surrounding the January 6 cases. The defense team's strategy reflects broader debates about prosecutorial discretion and equal application of justice.

Case Status and Forward Movement

A federal judge's denial of Steve Baker's motion to delay his January 6 trial marks another chapter in the complex legal proceedings surrounding Capitol protest coverage.

The Blaze Media investigative reporter faces four misdemeanor charges related to his presence at the Capitol while documenting the historic protests.

The case continues to move forward despite defense arguments citing Trump's election victory and the DOJ's pause in Trump's prosecution. Baker's trial remains scheduled for November 12, where his defense team will pursue their selective prosecution strategy, supported by evidence of uncharged journalists who covered the same events.
