The trial of Marine veteran Daniel Penny for the alleged manslaughter of a homeless man, Jordan Neely, began with the revelation of bodycam footage indicating Neely still had a pulse shortly after being restrained, Mail Online reported.

The incident that led to the high-profile trial occurred on May 1, 2023, on a subway train at Fulton Station in Manhattan. The confrontation between Penny, a 24-year-old former Marine, and Neely, a thirty-year-old homeless man, culminated in Penny administering a chokehold. Paramedics arrived approximately fifteen minutes after the police, with Neely still sprawled on the train floor at 3:13 pm. Although receiving immediate medical attention, Neely was not pronounced dead until he arrived at Lenox Health Hospital later that afternoon.

During opening statements, Assistant District Attorney Dafna Yoran presented a poignant portrayal of Neely’s plight, emphasizing the societal tendency to overlook such individuals.
