As Breitbart News reported, FEC Chairman Sean Cooksey declared that all donations to Joe Biden's campaign must be returned, refunded, or properly reassigned. This follows Biden's unexpected withdrawal from the race.

Joe Biden's premature departure from the November presidential election has triggered a meticulous review of campaign donations under FEC guidelines.

As Biden endorsed Vice President Kamala Harris to succeed him, legal intricacies surrounding the reallocation of campaign funds have come to the forefront.

FEC Chairman Sean Cooksey elaborated on the situation, emphasizing compliance with specific FEC rules concerning donation handling post-candidate withdrawal. This includes either the full refunding or appropriate redesignation of these funds in line with CFR rule 11 CFR 110.1.

Under the stipulated FEC rules, several avenues exist to handle funds. Redesignation options encompass excess contributions, contributions post-election, and those not earmarked for a specific election event.

Additionally, reattribution allows for a donor's confirmation to redistribute their contribution among several donors within 60 days.

This procedural clarity is crucial as Biden's campaign had accumulated approximately $100 million. However, transferring such a sizeable amount to another candidate involves stringent legal limitations.

Election lawyer Charlie Spies commented on the limited options available for transferring Biden’s campaign funds. Direct transfers to another Democratic nominee are capped at $2,000 until Biden is formally nominated. This legal nuance restricts the immediate reallocation of funds to potential candidates like Gavin Newsom, Gretchen Whitmer, or Kamala Harris.

Spies further outlined a hypothetical yet complex strategy that involves Biden obtaining the formal nomination before officially withdrawing to support Harris.

This would allow Harris to assume leadership of the campaign more seamlessly. Nevertheless, this approach carries risks, requiring the maintenance of a nominal candidacy under close public scrutiny for an extended period.

The Biden for President campaign had made strategic amendments in August 2023 to include Vice President Kamala Harris, a move that now gains significant relevance given current developments.
