Federal judge nullifies Biden's abortion promotion rule

In a decisive legal victory for religious rights, a federal judge has permanently overturned a Biden-era rule mandating that businesses promote abortion services. This significant ruling affects approximately 9,000 Catholic businesses across the country.

According to WorldNetDaily, A North Dakota federal judge has canceled a Biden administration mandate that enforced abortion promotion in businesses, siding with Catholic organizations.

The rule in question was issued by the Equal Employment Opportunity Commission (EEOC) under the administration of President Joe Biden. It expanded the interpretation of the Pregnant Workers Fairness Act (PWFA) to cover a wide array of reproductive issues, including abortion, positioning these as rights within the workplace.

This expansion led to significant backlash from religious groups, triggering a lawsuit by the Catholic Diocese of Bismarck and the Catholic Benefits Association. These groups argued that the rule compelled Catholic business owners to act against their deeply held religious convictions.

Religious Freedom Takes Center Stage in Court Decision

Judge Daniel Traynor of the District Court of North Dakota was the presiding judge over this case. He first issued a preliminary injunction last year, which temporarily halted the enforcement of the EEOC’s rule pending a more detailed examination of the case.

The judge's final decision to strike down the rule permanently was based on an evaluation that the Catholic plaintiffs were likely to succeed on their claim that the rule violated the Religious Freedom Restoration Act (RFRA). He noted that forcing religious business owners to promote abortion was not only a potential RFRA violation but also posed irreparable harm by making them choose between their beliefs and legal compliance.

"The actual language of the PWFA requires protections for 'pregnancy, childbirth, or related medical conditions,'" noted a report in the Washington Stand, reflecting on the original intent of the PWFA before its expansion under the Biden administration.

Judge Highlights Constitutional Rights in Ruling

Judge Traynor articulated his decision, mentioning, "The CBA is likely to succeed on the merits of the RFRA violation claim because the law forces members to choose between expressing sincerely held beliefs and compliance. This harm is irreparable, and upholding constitutional rights always weighs in favor of the public interest and an injunction."

He further criticized the EEOC’s overreach, stating, "The agency should have known it would not be allowed to force individuals to violate sincerely held religious beliefs."

Comments from conservative circles echoed Traynor’s criticisms. A publication known as the Washington Stand offered a scathing view on the Biden administration’s policies, suggesting a bias against Catholic values under the guise of legislative authority.

Public Reaction and Broader Implications

"The entire scenario serves as a reminder of the Biden administration's troubling record of anti-Catholic bias," read a statement from the Washington Stand. The publication criticized the administration's approach towards religious businesses, accusing it of extending policies contrary to religious freedoms.

According to the Washington Stand, the administration's policies distorted the meaning of the PWFA, "...as ironic as it may seem, political appointees of the nation's second Catholic president distorted the meaning of a pro-life law to require employers to subsidize abortion and other practices objectionable to Catholics."

The ruling not only underscores ongoing tensions between religious freedom and governmental policies but also represents a notable instance of judicial intervention in matters concerning religious rights versus federal regulatory overreach. This decision is likely to influence future litigations related to religious freedoms and employment laws, providing a reference for similar cases involving conflicts between religious beliefs and government mandates.
