Firm faces discrimination lawsuit over Obama Presidential Center construction

A racial discrimination lawsuit has escalated tensions surrounding the construction of the Obama Presidential Center in Chicago, involving a key structural engineering firm and a Black-owned subcontractor.

The lawsuit by II In One Concrete against Thornton Tomasetti claims $40.75 million in damages, accusing the firm of racially biased critiques at the prominent Chicago construction site, as Fox News reports.

Controversy Erupts at Obama Center

The controversy centers around Thornton Tomasetti, a structural engineering firm headquartered in New York City. The firm has been accused by II In One Concrete, a Black-owned subcontracting company, of racial discrimination.

This allegation stems from Thornton Tomasetti's review of II In One’s concrete work at the Obama Presidential Center construction site in Jackson Park, Chicago.

II In One Concrete contends that the criticism of their work by Thornton Tomasetti was racially motivated.

As a result, the company has filed a lawsuit demanding $40.75 million in damages. The amount represents what it claims as lost payments due to Thornton Tomasetti’s critiques, which II In One argues nearly led to their bankruptcy.

The Obama Presidential Center is intended to honor former President Barack Obama, featuring a 235-foot tower museum among other facilities. Its construction has, however, faced significant delays and budget overruns, ballooning from an initial $350 million to $830 million.

Understanding Lapse in Construction

In defense, Thornton Tomasetti has reported multiple instances of substandard work performed by II In One, including issues such as cracked concrete and exposed rebar. The firm attributes these flaws to the subcontractor’s inexperience and lack of proper qualifications for a project of this magnitude and complexity.

A memo issued by Thornton Tomasetti detailing these issues led directly to withholding payments to II In One Concrete. The withheld amount, the firm asserts, was necessary to cover the costs of corrective actions required to rectify the identified deficiencies in the construction work.

The Obama Presidential Center aims to showcase diversity, equity, and inclusion (DEI) by mandating that 35% of the subcontracting firms involved in its construction be minority-owned.

II In One Concrete was part of a joint venture that included over half minority-led firms, aligning with the DEI goals set out by the project.

Defense Strategy and DEI Goals

In a countermove, Thornton Tomasetti has filed a motion to dismiss the lawsuit. The firm argues that the claims of racial discrimination lack substantial factual support, categorizing the scrutiny as a natural aspect of all construction projects where high standards need to be maintained regardless of the contractor's ownership demographics.

Company attorneys stated, "Plaintiffs… are not immune from having their work scrutinized simply because they are minority-owned, or because the project prioritizes using the services of minority-owned businesses."

This statement underscores a critical aspect of the dispute, emphasizing that rigorous standards apply universally across all contractors on the project.

Further defending the firm's position, Thornton Tomasetti’s legal team expressed, "Professional criticism, without more, is not racism." They sought to clarify that any critique was strictly professional and aligned with maintaining the integrity of the construction specifications.

Response from Obama Foundation

The Obama Foundation, although not a party to the lawsuit, has expressed its commitment to fairness and anti-discrimination policies. According to Emily Bittner, VP of Communications at the Obama Foundation, "If the Foundation believed that any vendor was acting with a racist intent, we would immediately take appropriate action."

She elaborates that the construction's concrete work is largely complete and, should evidence of racially motivated actions surface, the Foundation would not hesitate to intervene.

This ongoing legal dispute sheds light on the complexities involved in enforcing DEI goals within large-scale projects, illustrating the tension between maintaining project standards and fostering an inclusive work environment. As the lawsuit progresses, all eyes will be on how these concerns are balanced against the backdrop of a project meant to symbolize unity and progress.
