Florida Judge halts church gatherings over parking conflict

A Florida church was ordered to cease public assemblies on January 23 after Seventh Circuit Judge Sandra Upchurch issued a temporary injunction over a parking dispute with a strip mall owner.

Coastal Family Church in Flagler Beach, represented by Liberty Counsel, cancelled its Sunday service and turned away congregants to avoid a $50,000 fine for violating the order. The church's leaders stood outside the facility to inform attendees of the closure.

The dispute involves a property covenant with Flagler Square, the strip mall owner, which prohibits the space from being used as a place of public assembly to preserve parking availability for other businesses. The case has raised questions about property rights and religious freedom in relation to commercial lease agreements.

Church Faces Unjust Restrictions on Worship

The roots of this clash lie in a supposed agreement made during property negotiations, where the church’s building—though owned by them—was bound by rules to prevent public gatherings. As reported by The Daily Caller, the court order insists this restriction serves the “public interest” of other mall tenants and claims the church knowingly violated the covenant with “eyes wide open.”

Yet, Liberty Counsel argues there’s no concrete evidence of any parking issues disrupting the mall. They also point out that the city formally approved a zoning exception for the church, which makes this judicial overreach even more baffling.

Mat Staver, founder of Liberty Counsel, didn’t mince words on the spiritual toll of this closure, declaring, “Every Sunday that the doors of Coastal Family Church remain closed inflicts irreparable spiritual and constitutional injury on its congregation.” This isn’t just about logistics; it’s about the soul of a community being stifled by bureaucratic nonsense.

Community Forced to Pivot Amid Shutdown

Faced with no other choice, church leaders have halted all collective worship, scripture teaching, communion, and congregational gatherings on the property. Founding pastor Roderick Palmer addressed his flock in a video, urging them to adapt by worshipping at home and rethinking their usual routines.

The church even filed an emergency motion, requesting relief by Saturday to resume services on Sunday. Until then, the congregation remains scattered, denied the fellowship that binds them together.

This situation reeks of the heavy-handed tactics seen during pandemic-era shutdowns, where places of faith were targeted while other establishments often got a pass. Staver himself drew the parallel, and it’s hard to argue against the eerie similarity in how quickly religious rights are sidelined.

Legal Battle Challenges Core Freedoms

The court’s assertion that the harm to Flagler Square outweighs any impact on the church is a slap in the face to believers who see their faith as non-negotiable. How can a few parking spaces be weighed against the eternal value of spiritual assembly?

Staver doubled down, stating, “The U.S. Constitution and Florida laws are clear that Pastor Roderick Palmer and Coastal Family Church have the right to hold church services on church property.” He’s right—restrictive covenants shouldn’t be weaponized to ban religious gatherings under the guise of “public interest.”

Look at the bigger picture: this isn’t just a local spat; it’s a test of whether property disputes can erode constitutional protections. If this injunction stands, what’s to stop other communities from facing similar assaults on their right to worship?

The church’s plea for emergency relief is a desperate bid to reclaim its sacred space, but the outcome remains uncertain. Every day their doors stay locked is another day the state oversteps into matters of faith.

This case could set a dangerous precedent, emboldening petty bureaucrats and property owners to wield vague rules against religious institutions. Conservatives must stand firm—our freedoms aren’t parking pawns to be traded away for convenience.

Coastal Family Church deserves better than being forced to “pivot” from their calling over a baseless dispute. It’s time for the courts to uphold the higher law of liberty and let this congregation worship in peace.
