New York AG Updates On $112 Million Juul Lawsuit Settlement

Attorney General Letitia James has provided an update on the utilization of funds from the substantial lawsuit settlement with electronic cigarette maker Juul Labs Inc.

According to Newsweek, Juul agreed to settle for a whopping $462 million with several states over its marketing tactics last year. Juul's settlement aims to rectify the aggressive marketing of addictive nicotine products to the youth.

Attorney General James Announces Allocation of Juul Funds

Among other beneficiaries like California, Colorado, Illinois, Massachusetts, New Mexico, and Washington D.C., New York was awarded $112.7 million from the total settlement funds. This financial resolution addresses the public and legal uproar about how Juul marketed its products to young audiences.

James' office announced on Wednesday that $27.1 million of New York’s portion had been distributed. Notably, about $12 million has been allocated to New York City, while close to $15 million will benefit the New York City School District specifically.

Distribution Focuses on Youth Vaping Prevention

The funds are designated to support a broad range of state initiatives to curb underage vaping. Every county, the Board of Cooperative Educational Services (BOCES), and the five largest cities in New York are set to receive funding.

James’ office outlined that the allocated funds must be used within five key categories. These include public education campaigns, community- and school-based anti-vaping programs, vaping cessation services, enforcement of vaping laws, and public health research into e-cigarette use among young people.

In a strong statement, Attorney General Letitia James said, "JUUL created a nationwide public health crisis by igniting an addiction wave among children."

She highlighted the grave implications of JUUL’s past marketing strategies, which predominantly targeted the youth, underscoring the need for funds to combat this ongoing crisis.

New York City Mayor Emphasizes Community Reinvestment

Supporting James' announcement, New York City Mayor Eric Adams pointed out the proactive steps the city will undertake using the settlement funds.

"Today, we are redirecting millions from JUUL Labs directly into community and youth-focused preventive and educational efforts," he stated.

Adams criticized Juul Labs for its role in fueling a public health crisis, particularly noting the surge in nicotine addiction among middle and high school students. He reaffirmed his administration’s commitment to vigorous enforcement against entities endangering youth health.

The settlement with Juul involves financial compensation and imposes stringent restrictions on how the company can market and sell its products.

This includes a prohibition of marketing that targets youth, a ban on using individuals under 35 in promotions, and limits on in-store and online purchases.

Impact of Juul’s Settlements on Business Practices

In response to the settlement and ongoing litigation, Juul has attempted to amend its business operations and marketing strategies.

In April 2023, Juul stated its commitment to resolving historical issues and enhancing initiatives to prevent underage use of its products.

“This settlement...reflects our current business practices, which were implemented as part of our company-wide reset in the fall of 2019,” Juul claimed, noting a significant 95 percent reduction in underage usage of its products since the shift.

Moreover, recent developments in the Food and Drug Administration (FDA) have influenced Juul’s market presence. On June 6, the FDA reversed a previous ban on Juul’s e-cigarette products, allowing them to remain on shelves while their marketing applications are under review. This decision came after the FDA ordered Juul to halt sales in 2022, which Juul contested.
