In a significant legal development, Ohio Attorney General David Yost has intervened on behalf of a pastor who used his church to house the homeless, sparking a debate over religious liberties and city regulations.

According to the Christian Post, The legal tussle centers on Dad's Place Church in Bryan, Ohio, after its pastor was convicted of violating fire codes while aiding the homeless.

Pastor Chris Avell of Dad's Place Church became the center of controversy when he decided to keep his church open around the clock in March 2023 to shelter homeless individuals during harsh weather conditions. This humanitarian act led to legal challenges, starting with multiple zoning law violations levied against him by city officials.

Despite reaching an agreement in January of the previous year to pause residential operations and work towards compliance with necessary safety measures, the church faced new challenges. In April, a fire inspection resulted in further citations against Dad's Place for not having an automated sprinkler system among other issues, emphasizing the ongoing safety concerns.

The situation escalated when Bryan Municipal Court found Pastor Avell guilty, fining him $200 and imposing a 60-day suspended jail sentence, which was stayed pending appeal. This judgment underscored the tension between religious freedom and public safety enforcement.

Attorney General Steps Up for Religious Freedom

Reacting to these legal proceedings, Ohio Attorney General David Yost filed an amicus brief earlier this week, advocating for Pastor Avell's right to religious liberty under the Ohio Constitution. The brief argued that the city's enforcement actions did not meet critical criteria for overriding religious practices.

“This case is about religious liberty,” Yost stated in the brief, arguing that Ohio requires a strict scrutiny test, which he believes should favor the church. He added that the city had neither demonstrated a compelling interest in its enforcement nor had it used the least restrictive means to achieve its goals.

The Attorney General's office stressed the need for the court to reevaluate the injunction against the church and suggested that the city's regulatory measures were excessive under the circumstances outlined.

Community and Legal Advocates Rally Behind Pastor

The First Liberty Institute (FLI), representing the church, expressed their gratitude towards AG Yost for his staunch defense of religious liberties. "We thank Attorney General Yost for his defense of Dad’s Place and his unflinching leadership in defense of religious liberty for all Ohioans," said Jeremy Dys, Senior Counsel at FLI.

Mayor Carrie Schlade of Bryan, however, highlighted the serious safety risks posed by the church's actions. "We must do this for the safety of the people using the church, renters in space above the church, and the businesses adjacent to the building," Schlade stated, describing the issue as a critical safety concern rather than merely a bureaucratic dispute.

FLI's counsel, Ryan Gardner, criticized the criminalization of Pastor Avell's actions, arguing that the church provided essential shelter and that the individuals were safer inside the church than outside in sub-zero temperatures.
