According to The Daily Caller, Schumer's office has defended their decision to abandon four appeals court nominees in exchange for expediting the confirmation process of numerous district court candidates.

Recent confirmations have succeeded through narrow margins, with two judges receiving approval through 50-48 votes. These confirmations occurred during the absence of Republican Senators Ted Cruz and Mike Braun, highlighting the impact of attendance on voting outcomes.
