Circuit, summarizing it as “a former president can be prosecuted because he’s being prosecuted.” This highlighted the complex legal nuances the court had to navigate.

The intense scrutiny continued as Justice Department lawyer Michael Dreeben argued against inviolable immunity, stating, “There is no immunity that is in the Constitution, unless this court creates it today,” which directly confronts the core of Trump’s defense.

The implications of the Supreme Court’s ruling extend into the political arena as well, with Trump likely to run in the upcoming presidential election. A delayed decision could push the D.C. trial past the election date, impacting how charges against him are handled should he win the presidency again.

The unanimous decision by a three-judge panel of the U.S. Court of Appeals for the D.C. Circuit, stating that Trump could face prosecution for his attempts to maintain power post-election, hangs over this Supreme Court challenge.
