Supreme Court To Examine Tennessee's Minor Gender Transition Law

The Supreme Court is set to evaluate a contentious Tennessee statute that restricts gender transition procedures for minors.

Tennessee's Senate Bill 1, which bans irreversible gender transition procedures for minors, including surgeries and hormonal treatments, took effect on July 1, 2023, after Governor Bill Lee signed it into law on March 22, 2023. The law has sparked substantial debate and legal challenges regarding the rights of transgender minors and the state's role in regulating health care.

The controversy intensified following a September 2022 investigation by Matt Walsh and The Daily Wire into Vanderbilt University Medical Center's approach to pediatric gender transition procedures, which prompted heightened scrutiny and legislative action.

Legal Challenges and Court Decisions Unfold

In the face of the law's commencement, the ACLU, joined by the Biden administration, quickly mounted a legal challenge representing a Nashville couple and their transgender son, as well as a Memphis-based doctor, Dr. Susan Lacy. Their lawsuit in April 2023 sought to halt the enforcement of Senate Bill 1.

A Tennessee district court initially responded by temporarily blocking the law in April 2023, offering a brief reprieve to those opposed to the statute. However, this block was short-lived, as a Sixth Circuit court reversed the ruling and upheld the law in September 2023, reinstating the restrictions imposed by the legislation.

The Justice Department and the ACLU combined their lawsuits into a unified case, United States v. Skrmetti, due to the complications and high stakes involved. The Supreme Court officially added the case to its docket in June 2024.
