Ex-FBI task force leaders charged with lying to Congress on Hunter Biden laptop

Two former senior FBI officials who helped shape the public story on Hunter Biden’s laptop before the 2020 election have been charged with lying to Congress about their roles, prosecutors say.

Nikki Floris and Bradley Benavides, both once senior officials on the FBI’s Foreign Influence Task Force, self-surrendered Friday after federal charges in Washington accused them of false statements to the House Judiciary Committee. The New York Post reported that DC U.S. Attorney Jeanine Pirro announced the case alongside FBI Director Kash Patel. Each faces up to five years in prison if convicted.

Prosecutors say the pair denied any meaningful role in the Hunter Biden laptop matter during 2023 congressional interviews, even as internal FBI emails and messages showed they were deep in the discussion right before Election Day.

Pirro put the core allegation in plain terms. She said the two “allegedly lied to Congress about their roles in the FBI’s Hunter Biden investigations, with one claiming they only learned about it from Wikipedia, despite evidence showing their involvement in helping shape the public narrative about Hunter Biden’s laptop right before the election.”

"Floris and Benavides allegedly lied to Congress about their roles in the FBI’s Hunter Biden investigations, with one claiming they only learned about it from Wikipedia, despite evidence showing their involvement in helping shape the public narrative about Hunter Biden’s laptop right before the election,"

The timing lands years after the laptop story first broke and after a long stretch of institutional pushback against that reporting. Readers who have followed the Biden family’s public controversies will recognize the pattern of delayed accountability.

July 2023 denials collide with 2020 emails

On July 19, 2023, Floris sat for a transcribed interview with the House Judiciary Committee. Asked whether she had “any involvement in the Hunter Biden investigation,” she answered, “I did not.” She also told lawmakers, “I don’t have any knowledge of said laptop.”

"I did not."

Benavides, asked when he learned of the ongoing criminal investigation tied to the laptop, pointed to a public webpage. His answer: “The Wikipedia page.”

Affidavit material and internal messages paint a different picture. The FBI had seized the laptop in December 2019. The New York Post published its first major story on the device’s emails on Oct. 14, 2020. In the days that followed, both Floris and Benavides assisted with the FBI’s response to press inquiries.

On Oct. 16, 2020, Benavides circulated an email that advanced the claim the laptop was a “Russian disinformation effort.” Floris replied, “Looks good!” That same period, Benavides organized a Microsoft Outlook meeting titled “To Discuss Laptop.”

"Looks good!"

Prosecutors say the pair discussed Hunter Biden and the laptop frequently in the run-up to the election and belonged to an informal working group called “Round River” that compiled informant-provided derogatory details on the younger Biden. After the election, Floris was looped into an email that included salacious claims about an alleged threat involving a sex worker in Los Angeles and a text that referenced an ankle bracelet and a recording laptop.

Defensive briefings and the public narrative

Floris and Benavides also delivered defensive briefings to Republican Sens. Chuck Grassley of Iowa and Ron Johnson of Wisconsin. Republicans later viewed those sessions as interference with legitimate oversight of alleged Biden family influence peddling. The House Judiciary Committee’s 2023 interviews grew out of that broader inquiry.

The laptop itself has remained a flashpoint long after 2020. Separate episodes involving Hunter Biden’s $LAPTOP meme coin have kept the device and its political fallout in the news for a different audience. The criminal charges now focus on whether two senior FBI hands told Congress the truth about their own work on the matter.

Judicial Watch President Tom Fitton told the Post the case marks a notable escalation. He called Floris and Benavides “the most senior figures to date who are being charged in the lawfare schemes against Trump, aside from [ex-FBI director] James Comey.”

"These are the most senior figures to date who are being charged in the lawfare schemes against Trump, aside from [ex-FBI director] James Comey,"

Attorneys call the case political

Floris’s lawyers rejected the charges outright. They said the Justice Department “has accused her falsely of a crime on the say-so of politicians, not on the facts.” They also argued, “It’s no coincidence the government is filing these nonsense charges now, years later, on the eve of an election,” and described their client as a “patriot.” Benavides’s attorneys have likewise denied wrongdoing.

The announcement arrives amid a wider stretch of high-profile enforcement actions in Washington, including a raid on the D.C. home of Rep. Ilhan Omar and the charging of a prominent Virginia Democrat in a separate case this month. Those matters are distinct, but they form the backdrop against which Pirro and Patel chose to publicize the Floris-Benavides filings.

For years, Americans watched media and intelligence voices treat the laptop as radioactive even after the FBI already held the device. The new charges do not retry the 2020 election. They ask a narrower question: whether two officials who helped manage the bureau’s public posture then later denied that work under oath.

Hunter Biden has stayed in the headlines for other reasons as well, from joint media appearances to family health updates. Recent coverage of Hunter Biden and Tucker Carlson rejecting antisemitism claims shows how quickly the younger Biden still draws national attention. None of that alters the sworn statements now under indictment.

What the record already showed

The government’s affidavit leans on more than a single email. It cites internal messages, other employees’ testimony, the “Round River” compilation work, and the press-response role both officials played after the Post’s October 2020 story. Prosecutors say that activity is hard to square with claims of zero involvement and Wikipedia-level knowledge.

Grassley and Johnson had been digging into foreign business dealings and influence questions around the Biden family. The defensive briefings from FITF officials landed as those senators pressed for answers. Whether the briefings were proper caution or political shielding remains a fight for the courtroom and for the public record.

Joe Biden’s own public profile has shifted in the years since. Coverage of how Biden stays mostly off the midterm trail reflects a different phase of Democratic politics, yet the laptop fight still trails the family name. The Floris and Benavides case returns the focus to the bureau’s conduct in 2020 and the testimony that followed.

Pirro’s office has not released a full public docket number or the complete charging language in the material summarized so far. The maximum exposure is clear enough: five years each on a conviction for lying to Congress. Both defendants remain free after self-surrender while the case proceeds.

Family stories continue to surface in other lanes, including reports that Hunter Biden reveals Joe Biden’s prostate cancer has advanced. Those personal developments sit apart from the false-statement charges, which turn on emails, meeting invites, and transcribed answers from 2023.

The Justice Department will have to prove the July 19 statements were knowing lies, not imperfect memory. The defense will argue politics drove the timing. The documents already in the public description, the “Russian disinformation” email, the “Looks good!” reply, the laptop meeting invite, and the press-inquiry work, give jurors a concrete timeline to weigh against the denials.

When senior FBI officials help frame a damaging story as foreign trickery weeks before a presidential election, then later tell Congress they barely knew the file existed, the public is entitled to a straight accounting. These charges are the first hard test of whether that accounting finally arrives.
