Republicans remind Democrats who set the raid precedent after Ilhan Omar home search sparks fury

Democrats erupted after federal agents searched Rep. Ilhan Omar’s Washington home in a fraud probe, and Republicans reminded them who cheered the Mar-a-Lago raid.

Homeland Security Investigations agents executed a court-authorized search warrant at the Minnesota Democrat’s Washington-area residence as part of an ongoing federal criminal investigation, the Justice Department confirmed.

Democratic lawmakers called the action political weaponization. Republicans answered that nobody is above the law and that Democrats themselves set this precedent when federal agents searched Donald Trump’s Mar-a-Lago home in 2022.

Fox News reported that President Trump addressed the search and said he had nothing to do with it. The warrant was handled through ordinary Justice Department and HSI channels, not a White House directive.

A judge signed off on probable cause

Two sources close to the investigation said the search stems from a criminal fraud probe into immigration paperwork filled out by Omar’s late father when she was a child. Omar has repeatedly denied fraud claims and any suggestion she is in the country unlawfully.

The New York Post reported that sources described compelling evidence of criminal activity behind the warrant, with the probe likely centered on claims she misrepresented her age to obtain citizenship as a minor in 2000. Agents were seen removing boxes from the home.

Former assistant U.S. attorney Jonathan Fahey put the legal threshold in plain terms for the Post.

"The big picture here is a federal judge in Washington, DC, signed off on a search warrant. That means there’s probable cause that a federal crime was committed, and there would be evidence of that crime in the area to be searched, which in this case was Representative Omar’s home."

A Justice Department spokesperson confirmed the mechanics in a statement carried across outlets: Homeland Security Investigations executed a judicially authorized search warrant secured by the Department of Justice as part of an ongoing federal investigation.

That process mirrors other high-stakes federal work in which career prosecutors and agents, not campaign staff, move cases forward, a pattern also visible when DOJ personnel shifted on separate Trump-related probes.

Democrats call it intimidation; the record shows a warrant

House Minority Leader Hakeem Jeffries, D-N.Y., framed the search as corrupt targeting of Trump’s adversaries.

"The Trump administration’s raid on Congresswoman Ilhan Omar’s home is deeply disturbing and raises serious questions about the continued corrupt weaponization of the federal government against Donald Trump’s adversaries."

Rep. Pramila Jayapal said Trump has been “obsessed” with Omar and called the move what “authoritarians do.” Rep. Ted Lieu, D-Calif., labeled it an “outrageous abuse of power by ICE” and noted Omar has been a U.S. citizen for 26 years after arriving as a child refugee. Sen. Bernie Sanders wrote that Trump is “weaponizing the federal government to silence opposition.”

Rep. Rashida Tlaib called it a “pre-dawn raid” and an abuse of power. Rep. Alexandria Ocasio-Cortez said the administration sent federal officials to Omar’s home and vowed not to accept what she called an unprecedented abuse. Sen. Tina Smith, D-Minn., cast the timing, with voting already underway in Minnesota and midterms less than a month away on Nov. 3, as election interference.

National Review reported that Omar herself accused Trump of an intimidation campaign. Border Czar Tom Homan had already confirmed in September that ICE was looking at long-reported questions around her immigration status, and Vice President JD Vance said in May the administration would examine fraud allegations that included entering under a false name.

Omar’s office did not immediately respond to a request for comment on the search. No charges related to her 2009 marriage to Ahmed Nur Said Elmi, a union critics have long claimed was a brother marriage for immigration purposes, which she denies, have been brought against her. The couple divorced in 2017.

Republicans point to Mar-a-Lago and equal rules

Rep. Nancy Mace, R-S.C., went straight at the double standard. She said she once tried to subpoena Omar’s immigration records and those of the man critics call her “brother-husband,” only to see both parties block the request in Oversight.

"All those who celebrated the raid of Mar-a-Lago don't get to cry over the raid at Ilhan Omar's home. Trump's political enemy raided his home. Democrats set the precedent."

Mace added that if fraud is proven, Omar “should be denaturalized and deported home to Somalia.” House Majority Whip Tom Emmer, R-Minn., struck a similar accountability note.

"Nobody is above the law. HSI just executed a search warrant at Ilhan Omar’s Washington, D.C. home. We look forward to learning more details about this raid and investigation. ACCOUNTABILITY IS COMING!"

Rep. Randy Fine, R-Fla., said that if Omar lied on immigration paperwork, she should face denaturalization and deportation “the same as anyone else. No more special treatment.” Rep. Anna Paulina Luna, R-Fla., said true allegations must be handled legally and tied the episode to her push, alongside members such as Kat Cammack and Fine, for disclosure when members of Congress hold dual citizenship.

Trump’s public denial of personal involvement fits a broader pattern of drawing hard lines on process while letting agencies do their work, much as when he defended an America First energy stance against political heat.

Fundraising starts before the facts land

Breitbart reported that Omar’s operation quickly turned the search into a donor pitch. A fundraising email cast the probe as a “baseless, partisan investigation” by Trump and DHS and urged supporters to stand with her as “attacks” escalate.

Homan, asked about the warrant, kept it brief: there was a warrant executed that morning, and he would leave it at that. He had previously said the underlying review had been underway for some time.

As of Tuesday morning after the Monday political eruption, House Speaker Mike Johnson had not issued a statement. Neither had Senate Minority Leader Chuck Schumer. Absentee voting in Minnesota began Sept. 18, and the state’s early-voting process was set to expand further as the Nov. 3 midterms approached.

Federal enforcement fights often spill into messaging wars, including episodes where the Justice Department had to clean up process errors in Trump-related matters. Here the core fact remains simpler: a federal judge found probable cause, HSI carried out the warrant, and boxes left the house.

Past Republican inquiries into Omar’s net worth and her husband Tim Mynett’s business ties never produced the kind of judicially approved home search now on the record. The difference is a signed warrant and an active criminal fraud theory tied to childhood immigration filings, not a press release.

Security and investigative arms of the government operate on their own tracks around the president, a reality underscored when the Secret Service confirmed protective tactics used for Trump in other contexts. Political noise does not revise a judge’s probable-cause finding.

Equal enforcement is not persecution. Democrats who applauded a former president’s home being searched now treat a colleague’s warrant as illegitimate because the target sits in their caucus, and voters can see the contradiction without a translator.
