FBI chiefs face perjury counts over Hunter Biden laptop blackout

FBI officials Nikki Floris and Bradley Benavides face perjury charges over suppressing Hunter Biden laptop reporting, as Kash Patel cites a private "shadow government" claim.

Bureau chief Kash Patel said Friday that Nikki Floris, then a deputy assistant director for counterterrorism, is on record privately claiming she was "running a shadow government" during the 2020 election.

Floris and her close colleague Bradley Benavides now face charges of perjury before Congress. The case centers on whether they hid how the FBI’s Foreign Influence Task Force was used to help bury reporting on Hunter Biden’s laptop before voters cast ballots.

Both officials testified in 2023 that they knew nothing about the laptop before the New York Post’s first stories landed on Oct. 14, 2020. An affidavit filed in D.C. federal court paints a different picture.

Court papers say the laptop talk started early

That affidavit alleges Floris and Benavides discussed the laptop often in the run-up to the election. The talks, it says, ran through briefings, emails, instant messages, and meetings.

Those discussions somehow treated the laptop as a Russian disinformation push. The FBI had already verified its own copy of the computer’s contents the prior December.

In other words, the bureau held authentic material months before the public saw it. Yet the official line still leaned hard into a foreign-plot story.

Readers tracking other bureau failures will recognize the pattern in FBI documents on Thomas Crooks and the unanswered questions around the Butler attack.

Social media got the warning first

Elvis Chan, a member of the Foreign Influence Task Force, spent that summer warning companies such as Facebook and Twitter. He told them the bureau suspected Moscow would launch a disinformation operation centered on Hunter Biden.

Those alerts primed the platforms long before the Post’s reporting broke. When the stories finally appeared, the groundwork for a freeze was already in place.

The sequence matters. First came the private warnings. Then came the public blackout. Then came sworn claims of ignorance.

"Running a shadow government"

Patel’s account puts Floris’s private boast in plain view. She is described as on record claiming that role during the 2020 contest.

The phrase is not spin from outside critics. It is attributed to her own private claim, as Patel relayed it.

Another ex-FBI agent has told investigators that Floris and Benavides belonged to Round River, an agency working group focused on Hunter’s scandals and “the potential for Russian disinformation.”

That membership undercuts any claim they sat far from the file. It places them inside the unit built to watch the very subject they later said they barely knew.

A “confidential” Senate briefing that did not stay quiet

In August of the election year, Floris and Benavides staged a confidential briefing for Senate Republicans. They warned lawmakers not to trust reports of Biden family corruption.

The performance leaked to the press. The message was clear enough: treat family-corruption stories as suspect, even as the bureau already held verified laptop material.

House Judiciary Committee members had already seen Floris on Capitol Hill in an earlier appearance, including a hearing captured in October 2019 photos. The later testimony in 2023 is what now collides with the court affidavit.

Related charging coverage on our desk includes the report that ex-FBI task force leaders were charged with lying to Congress on the same laptop fight.

What the 2023 testimony claimed

Under oath in 2023, Floris and Benavides each said they knew nothing of the laptop before Oct. 14, 2020. That is the date the Post’s reporting began to land.

The affidavit says the opposite timeline. It describes frequent pre-vote discussions that treated the device as a Russian operation after the FBI had already authenticated a copy.

Perjury before Congress is not a paperwork spat. It is a charge that the sworn story and the internal record do not match.

Lawmakers pressing the Justice Department on other fronts have also released Jack Smith transcripts on secret subpoenas of GOP phone records, another window into how far federal power stretched in those years.

Why the Foreign Influence Task Force sat at the center

The Foreign Influence Task Force exists to block foreign meddling. Critics of Floris and Benavides say the unit was turned toward a domestic political problem instead.

Hunter Biden’s laptop was not a foreign plant in the bureau’s own earlier verification. Yet the public messaging and the platform warnings still tracked a Moscow narrative.

Chan’s outreach to Facebook and Twitter fit that track. So did the August briefing that urged senators to doubt corruption reporting.

When agencies mix counter-influence tools with election-season narrative control, voters lose the chance to judge the evidence themselves.

Accountability fights inside the bureau have continued on other beats, including cases where counterterrorism supervisors were ousted after leaders said probes of threats were stifled.

The record the public can already see

Strip away the labels and the timeline is straightforward. The FBI verified the laptop contents in December before the election year heated up. Task force outreach to tech firms followed that summer. The August Senate briefing warned against corruption stories. The Post published in mid-October. 2023 testimony claimed no knowledge before that publication date. The new affidavit says the discussions were frequent and early. Patel has now put the “shadow government” claim on the record.

None of that requires mind-reading. It requires matching dates, roles, and sworn statements to the paper trail.

Floris held a senior counterterrorism post. Benavides worked beside her. Chan operated inside the same influence task force. Round River, per the ex-agent account, focused on Hunter’s scandals and Russian disinformation risk. Those are institutional facts, not vibes.

Slow-walked transparency has dogged other Trump-related files too, as when Fitton hit the FBI for a long drip of Butler shooting records.

What still is not public

Open questions remain. The full docket details and charge instruments are not laid out in the available reporting. The precise calendar date of Patel’s Friday remark is not fixed beyond the weekday. The complete original record of Floris’s private “shadow government” line is described rather than printed in full. The ex-FBI agent who named Round River membership is not identified by name here.

Those gaps do not erase the core collision. Sworn ignorance in 2023 sits against alleged pre-election discussions after an internal verification the prior December.

For a national audience, the plain meaning is simple. A powerful federal unit had tools meant for foreign threats. Senior officials are now accused of lying to Congress about what they knew and when they knew it. A bureau chief has described a private claim of running a shadow government in that same season.

Elections are decided by voters, not by quiet briefings and pre-cleared platform alerts. When the process is filtered first, the public never gets a fair look.

Clean government means the same rules for every ticket on the ballot. Anything less is not neutral law enforcement.
